v.

Commissioner of Wealth Tax

Law:

Section:

Section 7 read with section 2(q) of the Wealth-tax Act, 1957 - Valuation of assets - Others - Assessment year 1978-79 - Assessee was a film-distributor - For assessment year in question assessing authority determined value of films in stock - Tribunal held that fair market value of films lying in stock would be represented by actual collections at re-run of such films and, therefore, directed WTO to adopt value determined by actual collection made from exploitation of films on next valuation date - Whether test of actual collection on next valuation date might not be correct relevant factor for deciding as to what its value was on valuation date which undoubtedly was only relevant date for evaluating assets and, therefore, Tribunal erred in directing to evaluate films with reference to next valuation date - Held, yes [Matter remanded to Tribunal] FACTS The assessee was a film distributor.
