v.

United Insurance Co. Ltd.

Law:

Section:

I. Section 194A of the Income-tax Act, 1961 - Deduction of tax at source - Interest other than interest on securities - Assessment year 2003-04 Insurance company paying interest on compensation to accident victims is liable to deduct tax at source if there is tax liability after spreading interest over period from date interest was directed to be paid till its payment [In favour of revenue] The respondent-insurance company pursuant to the award made under the Motor Vehicles Act, had paid compensation to the victim of motor vehicle accident. If the spread over was given in majority of cases, the respondent may not incur liability to pay any TDS. In the event the respondent remitted the TDS amount as directed by Tribunal, the revenue was directed to hold suo motuenquiry by issuing notice to the persons who had received compensation to find out their tax liability on the interest received. If it was found that there was a tax liability on the person concerned, the revenue should collect the tax from the person concerned and refund the amount to the respondent. So also, if there was no tax liability on the person concerned, the TDS collected should be refunded to the respondent, of course with interest in either case. II. Section 201 of Income-tax Act 1961 - Deduction of tax at source - Consequence of failure to deduct or pay - Assessment year…
