J.-The petitioner is an Assistant Consolida­tion Officer. His name was included by the Commissioner in the list of Kanungos who were considered fit to officiate as Naib­ Tehsildars. Later when the Commissioner selected 15 persons as Naib-Tehsildars from among the subordinate service, his claim was ignored. He, therefore, moved a writ in the High Court, challenging the order of the Commissioner. The Commis­sioner, in his report to the High Court, stated that he selected the officers with due regard to merit and seniority and that due to adverse confidential reports the petitioner was not selected for the post of Naib-Tehsildar.
