Land Acquisition Act (I of 1894)--- ----Ss. 4, 5-A & 17---Land Acquisition Rules,1983, Rr. 10 & 11---Acquisition of land-- -Objection to---Notification according to which land in dispute was acquired for establishment of Small Industrial Estate, was challenged by owner of land, firstly that land was not being acquired for any public work, but was being acquired for a corporation for which it could not legally be acquired; secondly that land in dispute which was situated in neighbourhood of Town was meant for fodder and cultivation thus could not be acquired as only sonic vacant land could be acquired for establishment of Industrial Estate--­Notification demonstrated beyond doubt that land in question was being acquired for a public purpose and definitely not for benefit of a Company or Corporation as contended by owners of land---Punjab Small Industrial Corporation, was an agency being run and founded by Provincial Government, thus it was a part and parcel of Government---Contention of owners of land that land was not being acquired for public work, but only for benefit of Company, was repelled, in circumstances---Part of land in dispute was under plough while rest was undoubtedly lying vacant and Member, Board of Revenue himself visited the site and gave finding of fact that no other suitable area was available for establishment of Small Industrial Estate for which land in dispute was being acquired---Contention of owners of land that land in dispute could not acquired as same was under plough, was repelled---Land in dispute was rightly acquired for a public purpose which was to establish an Industrial Estate.
