Industrial Relations Ordinance (XXIII of 1969)-- ---S. 25-A---Grievance petition against termination of services---Respondent denying relationship of employer and employee between themselves---Respondents' admission that on complaint of applicant he appeared before Labour Officer and gave rupees five hundred to employee as a charity---Factum of payment of such amount by respondents to applicant during meeting before Labour Officer established the fact that respondents considered that applicant was their employee and they were liable to pay said amount to him---Such circumstance as reflected from record proved that applicant had been employee of respondents and his services had been terminated by them---As respondents had not categorically challenged other assertion of applicant that his services were illegally and unlawfully terminated same stood established---Respondents were ordered to reinstate applicant within specified time. ORDER The applicant has filed this application under section 25-A of the I.R.O. 1969 stating therein that he has been worker of the respondents since 1972 and from December 1984 he used to work 12 hours daily without benefits of overtime, he demanded it but he was kept on promises. His bonus of years 1985, 1986, 1987, leave encashment of 90 days earned leave and Cost of Living Allowance was also stopped for which he has filed a separate case before the competent authority. He used to demand his rights, wherein the management was annoyed and the respondent terminated his service on 29-7-1987 arbitrarily without assigning any reasons. He submitted that he approached Labour Directorate and he was assured for reinstatement. The respondent refused to reinstate him and give him dues therefore the applicant sent a grievance notice to the respondent to which the respondent also replied. The applicant has therefore prayed for reinstatement with full back benefits.
