Disabled Persons (Employment and Rehabilitation) Ordinance (Y.L of 1981)--- S. 16(3)--'-Constitution of Pakistan (1973),. Art. 199 --- Constitutional petition --- Disabled person's entitlement to be recruited to specified post-- ­Number of posts in relevant. establishment was 68 and keeping in view provision of S. 10(3), Disabled Persons (Employment and Rehabilitation) Ordinance, 198 1, one disabled person had necessarily to be recruited --- Authority had no objection if petitioner's Constitutional petition was accepted --- Counsel of Authority had -not contested and objected to positive effort being made by petitioner (who was a Law Graduate) for a good cause to lead happy, laborious and convenient life --- High Court, keeping in view concession given, by Authoritys' counsel, accepted petitioner's plea to hold -that he has entitled/competent to be recruited (as sub-accountant) in the Department-~ Authority was directed to issue appointment letter to petitioner who would be entitled to his salary emoluments from the date of joining service. JUDGMENT The facts giving rise to this writ petition are as under Sajid Kareem petitioner is a law graduate. He is unfortunately an infirm and polio-affected person. Even though he tried his luck in the legal profession, but he could not. successfully indulge therein due to his disability. He chose to join some service. Fortunately the posts of Sub-Accountants in BS-1 I in the office of the treasury Officer, D.G. Khan fell vacant and as required by law the publication for recruitment was made in the Daily Nawa-i-Waqt, Multan on 18-12-1994. - The petitioner competed alongwith other persons. Two candidates were to be recruited on permanent basis and two, on temporary basis Sajid Kareern petitioner competed for the post of Sub-Accountant and he applied as a disabled candidate. However, he was considered alongwith other candidates and not as a disabled candidate. He was not recruited. Two candidates were -recruited against permanent posts who joined while two were recruited against temporary posts out of whom one did not join his job.
