Industrial Relations Ordinance (XXIII of 1969)-------Ss. 25-A(8) & 38(3-a)---Revision against order of Labour Court--- Maintainability--- Employee had filed complaint against employer under S.25-A(8), Industrial Relations Ordinance, 1969---Complainant and his counsel remained absent on relevant date of hearing whereas employers were represented by their counsel and filed application under 5.249-A, Cr.P.C.--­Labour Court ordered issuance of notice to complainant employee and put off case to next date of hearing--Said order passed by Labour Court was a routine order for notice on application of employer filed under S.249-A, Cr.P.C. and summoning the accused---In absence of any illegality in said order' of Labour Court which was not a final order, same was to be maintained. Mahboob Rizvi, Representative for Applicant Rafiullah for Respondents JUDGMENT This is a revision application under section 38(3-a) of the Industrial Relations Ordinance, 1969, against the order, dated 2-4-1999, passed by the Sindh Labour Court No.1 at Karachi, which is reproduced as under:-- "EXTRACT FROM ORDER SHEET 2-4-1999. Complainant and his Advocate called absent. Syed Saleem Hussain Zaidi, is present for accused No.4. Mr. Mehboob Rizv Representative is present and filed his Vakalat-nama for accused persons.
