Industrial Relations Ordinance (XXIII of 1969)-------Ss. 5 & 38(3-a)---Registration of trade union---Application for registration of trade union of workers was dismissed by Registrar, Trade Unions on ground that applicants were employees of job contractor and not of respondent-Company and that relationship of employer and employee did not exist between the patties---Order of Registrar of Trade Unions was upheld in appeal by Labour Court and applicants filed revision against of Labour Court---Main grievance of applicants was that on date of hearing of appeal counsel for applicants sent an application for adjournment to Labour Court supported by medical certificate which was disallowed and as some of the applicants, who were present in Court, were not in a position to argue case, same was decided against them---Labour Appellate Tribunal, in interest of justice, remanded the case to Labour Court to decide the same after giving opportunity to contesting parties as it was not shown that .applicants were wasting time of Court and had adopted delaying tactics. JUDGMENT This is a revision application under section 38(3-a) of the Industrial Relations Ordinance, 1969 against the decision dated 15-9-1998, passed by the learned Labour Court No.5, Karachi, against the order dated 20-8-1998, passed by the learned Registrar Trade Unions. 2. The facts giving rise to the above revision, briefly stated are, that the applicant union namely Pak Suzuki Motor Co., Limited Star Workers' Union, formed on 22-6-1998, filed an application for its registration to the Registrar Trade Unions, on 2nd July, 1998 claiming to be the employees of Pak Suzuki Motor Company Limited. Under the constitution of the applicant Union, it is provided that the employees of Pak Suzuki Motor Company could only become the paid members of the Union.
