Police Rules, 1934-------R. 12.2(3)---Deferment of case of confirmation of civil servant--­Representation of civil servant for confirmation as Sub-Inspector Police from date of her appointment and promotion was rejected simply because her service record was not available on first occasion when her case was considered for confirmation---Civil servant could not be deprived of her right for confirmation from due date as deferment of her case was not due to her fault---Rule 12.2(3), Police Rules, 1934 provides that all appointments of enrolled Police Officers were on probation and their seniority inter se was to be determined from date of their appointment and then from date of confirmation---Seniority inter se of several officers was confirmed from date of their first appointment but said civil servant was confirmed after about seven years of her appointment---Authorities had not shown any rule under which date of confirmation could not be the date of appointment of civil servant or it could be any date which Competent Authority could fix in its own discretion without assigning any reason---Civil servant who had a good record of service, was well-qualified and had earned commandation certificate and cash awards and never earned any adverse report in her career and also had fulfilled requisite condition of passing prescribed training course which was prerequisite for confirmation as Sub-Inspector of Police was entitled to be confirmed from date of her appointment especially when other civil servants who were appointed later than civil servant were confirmed from date of their appointment.
