(a) Educational institution------- Constitution of Pakistan (1973), Art. 199---Constitutional petition--­Petitioner, a student of University of Engineering and Technology was admitted in 1992, passed successfully First Examination of B.Sc. Engineering and thereafter was expelled from the University on charge of having submitted tampered result card---University Authorities, on scrutiny of petitioner's result informed University of Engineering and Technology that result card submitted by petitioner was correct and alleged tampering therein, was due to the fact that there being some mistake in calculation of marks, result card was corrected there and then---University of Engineering and Technology, thereafter recalled its order of expulsion and admitted petitioner again--­Petitioner having earlier cleared his First Year Examination applied to the University of Engineering and Technology to allow him to appear in supplementary examination due to take place in February 1995, which was refused ---Validity---High, petitioner was made to suffer not because of his own fault but because of delay and omission occasioned at the Office of Punjab University on account of verification of result card or for that matter by the University of Engineering and Technology---No one could suffer on account of act of Authority who had to pass an order or who had to take some action-- Leisurely attitude adopted by both Universities in authenticating result of petitioner could not be made-basis for depriving petitioner from his real entry in the University i.e., in 1992, when allegations levelled against him had not been authenticated---Petitioner had, thus, got right to be restored to his original position and allowed to take supplementary examination to be held in February, 1995---Relegating petitioner to subsequent entry i.e. 1,993 after his readmission was not warranted---University of Engineering' and 'technology was directed by High Court to allow petitioner status of 1992 entry (the year in which he got admission) and allow him to take examination of 2nd year in, February, 1995.
