(a) North-West Frontier Province Public Service Commission (Function) Rules, 1974--R. 4---Constitution of Pakistan (1973); Art. 185(3)---Competitive examination- --Petitioners were not recommended for appointment on account of their low position in merit list---No waiting list was maintained, by Public Service Commission in view of Supreme Court in Musa Wazir's case (1993 SCMR 1124)---Petitioners' Constitutional petitions were dismissed by the High Court, wherein petitioners' plea that their tests/interviews having taken place before the date of decision in Musa Wazir's case, which applied prospectively, petitioners should have been shown in the waiting list of candidates, and that they should have been recommended by the Commission against vacancies which occurred within six months of preparation of such waiting list---Validity---Leave to appeal was granted to consider the contention raised by petitioners and further to consider whether .on the basis of said list some candidates, who were interviewed with the petitioners and were not selected, were selected after the decision of said Wazir Musa's case whether said was distinguishable and could not operate retrospectively; and whether petitioners had acquired vested right before announcement of in Musa Wazir's case supra and they could not be deprived of that right.
