Sindh Service Tribunals Act .(XV of 1973)--- ----S. 4---Non-inclusion of, name of civil servant, a police official, in "F" list--­Challenge to---Jurisdiction of Tribunal---List "F" based on recommendation of Departmental Promotion Committee (D.P.C.) was prepared in which names of civil servants (Sub-Inspectors of Police) other than civil servant were included, but name of civil servant was -ignored for want of requisite experience of working at police station---Non-inclusion of name in "F" list had been challenged by civil servant by filing appeal before Tribunal---Names of only those civil servants (Sub-Inspectors) were entered in `F list on recommendation of D.P.C. who, after close scrutiny of their service record were declared fit for promotion to higher grade and civil servant was ignored for want of requisite experience of working in police station---Departmental Authorities alone could determine fitness of civil servants for promotion and civil Tribunal had no jurisdiction to take a decision with regard to fitness of a civil servant for promotion---If a civil servant was not considered for promotion on his due turn, although he was eligible for same, Service Tribunal in that case only had power to intervene and issue appropriate direction that-civil servant be considered for promotion. In brief the facts leading to passing of the above-impugned order are these: the appellant joined Police Department as ASI with effect from 1-11-1976.
