Sharifan filed a suit for jactitation of marriage that she is not the wife of Murad. She made an application before the trial Court that Mashooq Khan who is her earlier husband may be summoned as a witness so that it may be ascertained as to how did she obtain divorce from him. The learned trial Court came to the conclusion that evidence of this witness was necessary for proper decision of the case and it was, therefore, directed that he be summoned as a court-witness.
