(a) Industrial Relations Ordinance (XXIII of 1969)--- ----S. 25-A---West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VI of 1968), S.O. 15(3)(a)(h) & (4)---Dismissal from service---Employees were dismissed from service after issuing 'them show-cause notices and holding enquiry against them on allegation that they not only refused to carry out reasonable and lawful orders of their superiors, but also threatened said superiors---No allegation of enmity or bias was made by employees against Enquiry Officer or the manner of conducting enquiry by him either in their grievance notice or in grievance petition or in their affidavit-in-evidence--­Evidence on record had fully proved that Enquiry Officer had conducted enquiry into misconduct alleged in charge-sheet against employees, honestly, fairly and impartially and without any influence from employer---Employees neither in their grievance notice nor in their grievance petitions or in their affidavit-in-evidence had alleged that witness who gave evidence against them in domestic enquiry had any enmity or animosity against them---Misconduct of employees on basis of which they were dismissed from service having fully been proved, employees were rightly dismissed from service and order of dismissal could not be interfered with. (b) West 'Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VI of 1968)--- ----S.O. 15(3)(h)---Misconduct---Act subversive of discipline---Threat given to a superior by a worker outside factory premises in connection with an occurrence in factory, would be covered by S.O. 15(3)(h) of West Pakistan Industrial and Commercial Employment (Standing' Orders) Ordinance, 1968 as an act subversive of discipline. 1980 PLC 972 ref.
