Civil Servants Act (LXXI of 1973)--- ----Ss.10 & 11---Transfer---Validity---Civil servants were working in Prime Minister's Secretariat but due tore-organization they were declare surplus and their services were placed at the disposal of Establishment Division for absorption---Establishment Division absorbed civil servants against equivalent pots in other Ministries/Department---Civil servants challenged their transfer alleging that order declaring civil servants as surplus due to re-organization and their transfer to other departments was in contravention of terms and conditions of their services---Services of civil servants were not terminated, but were placed at disposal of Establishment Division for further absorption and were immediately absorbed in other departments where they had joined--­Government had prerogative to adopt, suitable economy measures in national interest and every civil servant was liable to serve anywhere within outside Pakistan in any equivalent post---On abolition of posts of civil secants in Prime Minister's Secretariat, Government had taken care of their services and " had absorbed them against equivalent posts in other Ministries ---Government in circumstances had not violated terms and conditions of their services especially when such civil servants had not placed on record any document or seniority list to show that juniors were retained and they were ousted to be absorbed in other departments.
