Civil Servants Act (LXXI of 1973)-- ----S. 10---Civil Servants (Efficiency and Discipline) Rules, 1973, R.5(1)(iii)---Removal from service---Transfer---Absence from duty--­Appellant an Ex-UDC in National Saving Directorate, was removed from service when he defied order of his transfer from one Centre to another in same city and remained absent from duty after he was transferred and relieved---Appellant made lame excuse of his sickness and continued to .disregard instructions---Appellant remained wilfully absent from duty and took plea that he was not given show-cause notice which prejudiced his cause--­Show-cause notice under R. 5(1)(iii) of Civil Servants (Efficiency and Discipline) Rules, 1973 having been issued to appellant---There was no requirement of regular inquiry and thus no prejudice had been caused to him---Appeal of appellant was dismissed but since he had a long service, punishment of removal from service was altered to compulsory retirement. 1988 SCMR 617 and PLh1 1988 SC 35 ref. RAHMAN KHAN (MEMBER).---Mr. Ahsan A. Shauque, the appellant, Ex-UDC, National Savings Directorate, has come in appeal against the impugned order dated 5-9-1987 whereby he was removed from service with immediate effect. His departmental appeal, dated 19th September, 1987 remained unresponded. 2. Briefly, the facts of the case are that the appellant was working as Upper Division Clerk in the National Savings Centre Samanabad, Lahore when he was transferred to National Savings Centre, Ravi Road vide order dated 22-3-1986 but he failed to join his duties. He was, therefore, served with the show-cause notice, dated 28-5-1986, extract of which is reproduced below: (i) You did not join your duties at National Savings Centre, Ravi Road, Lahore on transfer from National Savings Centre, Samanabad, Lahore, after being relieved on 16-4-1986.
