Section:

(a) Constitution of Pakistan (1973)--- ----Art. 185(3)---Leave to appeal was granted to consider whether High Court had misread evidence and had ignored material evidence. (b) Transfer of Property Act (IV of 1882)--Ss. 54 & 53-A---Construction of document---Concurrent finding of fact by Courts below---Effect---Constitution of Pakistan (1973), Art.185---Agreement whether a sale-deed or agreement of sale---Contents of document in question, showed that such document was only an agreement of sale and not a sale-deed---Courts below had also come to same conclusion and in so doing Court had not misread the evidence---Finding of fact which was based on proper appreciation of evidence was not open to exception.
