(a) Industrial Relations Ordinance (XXIII of 1969)--- ----S. 25-A---West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VI of 1968), S.O. 15(3)---Wage Commission Award, 1978---Efficiency and Discipline Rules framed by or under Award Commission---Statutory Rules---Rules framed by Wage Commission or Rules framed by Bank on basis of such Award are not statutory Rules---Efficiency and Discipline Rules framed by or under Wage Commission not being Statutory Rules, do not supersede Standing Orders Ordinance, 1968 and cannot confer any authority upon the employer Bank to order dismissal of employee on basis of proceedings initiated under said Rules---Order passed against employee was, thus, without lawful authority. (c) West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VI of 1968)--- ----S.O.15(3)---Dismissal from service---Misconduct---Dismissal without serving notice---Standing Order 15(3), a mandatory provision of law requiring employers to bring act of misconduct to notice of workman within prescribed period---Order of dismissal having been passed without observing said provision of law was declared to be without lawful authority and void. (d) Industrial Relations Ordinance (XXIII of 1969)--- ----S. 25-A---West Pakistan Industrial. and Commercial Employment (Standing Orders) Ordinance (VI of 1968), S.O. 15(3)---Dismissal---Unauthorised absence---Worker was charged for unauthorised absence for less than ten days, punishment for which was not dismissal---Order of dismissal was declared to be without lawful authority and void.
