Industrial Relations Ordinance (XXIII of 1969)--- ----S. 25-A---Reinstatement---Respondent who was working as Bus conductor when checked by Checking Party was found to have charged fare from sixty ­one passengers and had not issued tickets to them---Respondent was found guilty in domestic inquiry and was ultimately dismissed from service--­Passengers from whom employee was alleged to have obtained fare without issuing tickets were not examined before Enquiry Officer or before Labour Court---Documentary evidence had also not been produced to show that aforesaid persons were confronted with conductor---Held, without confrontation of each passenger or without examining passengers before Enquiry Officer or Court, alleged guilt of conductor could not be held to be proved---Order of Labour Court reinstating respondent in service was upheld. 1988 PLC 484;1989 PLC 864 and 1989 PLC 865 rel.
