Civil service---- ----Adverse remarks were added by countersigning Authority---Civil servant's A.C.R. for the relevant year was initiated by Reporting Officer who did not record any adverse remarks therein---Reporting Officer, in fact, rated civil servant's integrity both moral and intellectual as "Good" (a) and endorsed the Column relating to standard of living which stated "lives within known means of income"---Same Reporting Officer subsequently verbally told the Incharge Officer (Countersigning Authority) that civil servant lived beyond means and had a bad reputation---Because of such oral communication, impugned remarks were added in the A.C.R. of civil servant by the Countersigning Authority ---Impunged adverse remarks had no valid and acceptable basis--­ Oral communication of Reporting Officer which formed the sole basis for the adverse remarks added by Counter singing Authority was totally belied by the formal and solemn assessment which the Reporting Officer had made of civil servant's integrity, moral character, life style and overall conduct---Except oral communication, no other material was available with the countersigning Authority in support of impugned remarks---No complaint was ever made against the integrity or reputation of civil servant nor was there any allegation that he was living beyond his means---No adverse comment was ever made on the integrity and reputation of civil servant in any of the A.C.Rs. from 1967 (the year of joining the service) upto 1973---Integrity of civil servant was rated "good" for the years 1969, 1970 and 1972 and "very good" for the year 1971--Civil servant all along from 1967 to 1973 was reported to be living within known means of income---Civil servant with such service record against whom not even a single complaint of dishonesty was received for seven long years did not deserve the impugned remarks assigned to him ---A.C.Rs. of civil servant in the post adverse remarks years also spoke well of his integrity and reputation---No valid justification existed for the impugned adverse remarks which were ordered to be expunged from the civil servant's A.C.R. for the relevant year.
