Punjab Service Tribunals Act (IX of 1974) - -- S. 4 - Disciplinary action - Quantum of punishment Sub, Divisional Officer (Engineer) and District Engineer charged for making over payment to work contractor on basis of S. F. T. instead of C. F. T.---Service Tribunal seeking assistance of an Engineer for technical advice-Such Engineer expressing view that mode of payment is always on C. F. T. basis and never on S. F. T. basis and that if in agreement word 'S. F. T." is inserted it should have alerted senior officer (District Engineer) who should have at once called for explanation of subordinate (S. D. O.)-Payment made on recommendation of District Engineer-Penalty of withholding two increments imposed on District Engineer but penalty of removal from service imposed on S. D. O. (appellant) on grounds that word "S. F. T." was initially inserted in agreement by him -Guilt of appellant, in circumstances, held, much lesser than that of District Engineer-Service Tribunal, in circumstances, setting aside impugned penalty order of removal from service and reducing penalty of appellant to that of forfeiture of two increments bringing same at par with that imposed on District Engineer. ABDUL JABBAR KHAN (CHAIRMAN).--The appellant has filed this appeal under section 4 of the Punjab Service Tribunal Act, 1974 in which he has impleaded Government of the Punjab, through Secretary Local Government and Rural Development Department Lahore as respondent. 2. By virtue of this appeal he has prayed that the order dated 6th January, 1983 passed by respondent whereby appellant has been removed from service be set aside and he be reinstated with all the back benefits. 3. Brief facts of the case are that the appellant was serving as Sub-Divisional Officer in the Peoples Work Programme during the year 1972-73 at Mianwali. During the tenure at Mianwah a work namely construction of Road Behal Town, Behal Railway Station length one mile was entrusted to the appellant.
