JUDGMENT MIAN FAIZ KARIM (MEMBER).-Qazi Iftikhar Ahmad has filed the appeal under section 4 of the Punjab Service Tribunals Act, 1974 in which he had impleaded the respondents as mentioned above. 2. Through this appeal the appellant has prayed that the impugned orders, dated 7th August, 1983 and 30th August, 1983 be set aside and he may be allowed to work as Accounts Clerk in SCARP II Circle. 3. Brief facts of the case and grounds of the appeal are that the appellant initially was recruited as Junior Clerk in Nili Bar Circle, Sahiwal on 15th December, 1962 and transferred to Upper Jhelum Canal Circle in April, 1970. Subsequently by order dated 28th May, 1974 of Secretary to Government of the Punjab, Irrigation and Power Department the reorganization of the various Divisions took place and a new Division, namely Mandi Bahauddin Distribution Division was created w. e. f. 1st July. 1974. Thereby the appellant was transferred from Upper Jhelum Canal Circle to newly-created SCARP II Circle of Sargodha. On further reorganization his services were again placed at the disposal of Superin­tending Engineer SCARP II, Sargodha, vide order of the Chief Engineer. Irrigation on 31st January, 1975. However, the appellant instead of being allocated to U. J. C was posted to SCARP II Circle on the basis of appel­lant seniority in SCARP II. He was promoted as Sub-Divisional Clerk w. e. f. 20th February. 1975 and further promoted as Accounts Clerk in SCARP II w. e. f. 20th February, 1980. However, in November Superin­tending Engineer, U. J. C. issued order dated 24th November. 1975 where­by the appellant alongwith others who were originally working in U. J. C. were allocated to SCARP II Circle and were repatriated as Assistant Clerk.
