Industrial Relations Ordinance (XXIII of 1969)- -- S. 22-A [as inserted vide Labour Laws (Amendment) Ordinance (IX of 1972)) read with National Industrial Relations (Procedure and Functions) Regulations, 1973, para. 34 - Transfer - Interim relief by way of stay order-Joint Secretary of C. B. A. challenging transfer order on plea of having been due to his union activities ­Plea that Joint Secretary was not an important officer and could perform functions only in absence of General Secretary - Status of person whether he is a member or officer in trade union, held, immaterial and what is to be seen was whether or not unfair labour practice had been committed in passing impugned transfer order ­Transfer made only for seasonal period to tide over a particular situation-Question whether or not there was unfair labour practice, held, could be decided after evidence-Post against which transfer ordered lasting only for a small period and stay if granted amount­ing to total relief-Stay application, in circumstances, dismissed. ORDER The facts leading to this application for interim relief filed along with petition under section 22-A of the I. R. O., 1969 read with regulation 34 of the N. I. R. C. (Procedure and Functions) Regulations, 1973 are that the petitioner is a booking clerk employed in the G. T. S. Saddar Depot Punjab Road Transport Board, Labore. He is the elected Joint Secretary of the G. T. S. Employees Union which is the C. B. A. for the said establishment. It is alleged that he used to meet the respondent District Manager in connection with day to day problems of workers and had in fact met him in connection with the illegal suspension of one Muhammad Nawaz, Driver, whom he bad charge-sheeted and suspended on baseless charges.
