Government Servants (Efficiency and Discipline) Rules, 1973---- -- Rr. 3 & 4 (I) (a) (i)-Misconduct-Censure-Main charge against appellant publication of report of zone falling within his charge for year 1975-76 without any authority and waste of con­siderable amount thereon-Some order though passed as to reports having to be published by Federal Government itself by collecting information from different zones but such order 'not relating to year 1975-76 but connected with year 1976-77-No consolidated report of different zones even then published by Chief . . ;: Director-Appellant in circumstances shown to have been harassed on flimsy grounds without any fault of his-Record showing an adverse report having been given to appellant and such report expunged as a whole-Chief Director posted at time also appearing to have desired re-employment- after attaining age of superannuation and he could get same only when no person qualified to replace him available in Department-Appellant being only person qualified to replace Chief Director but by earning bad report and punishment of censure deprived of promotion and such Chief Director continuing to hold post, appellant's case in view of attending circumstances, held, a clear case of mala fides and order of censure passed against him not sustainable. JUSTICE SHAH ABOUR RASHID (CHAIRMAN).--The appellant, while serving as Director, National Savings at Karachi, was served on 3rd May, 1977, with a show-cause notice dated 14th March, 1977. The show­cause notice reads as under :- "The Annual Report of the Directorate of National Savings Karachi for 1974-75 was printed and circulated by you without the prior approval of the Head of the Department, i. e. Chief Director, National Savings. A considerable amount of money was wasted on printing of this report because an unusually high rate was accepted by you for designing and printing of the report.
