(a) Punjab Service Tribunals Act (IX of 1974)- -----S. 4-Limitation-First representation against impugned order rejected-Subsequent continued agitation before departmental authorities cannot enlarge period of limitation for purposes of appeal before Service Tribunal. (b) Punjab Service Tribunals Act (IX of 1974)--- -- S. 4, proviso-Scope-Head Constable of Police removed from List C-I and reverted to substantive rank of Constable as a penalty­ Such penalty order subsequently held illegal and quashed by Civil Court-After consequential re-instatement claiming promotion or deputing for training of Intermediate course-Request rejected by departmental authorities on grounds of his becoming overage and prayer for relaxation of age as per requirements of rules rejected-­Service Tribunal, held, precluded to pass any positive order directing departmental authorities to relax rule which was their prerogative and within their discretion-Service Tribunal, however, expressed with that departmental authorities to have passed order of rejection of request for relaxation of age after taking into consideration pros and cons of case. JUDGMENT MALIK ZAWWAR HUSSAIN (MEMBER).-Abdul Ghafoor, Head­-Constable No. 843 has filed this appeal under section 4 of the Punjab Service Tribunal Act, 1974 against the order dated 22nd July, 1981 passed by the Deputy Inspector-General of Police, Lahore Range, Lahore (communicated on 28th November, 1981) whereby his representation review petition regarding the promotion was rejected. 2. By virtue of this appeal he has prayed that the impugned order dated 22nd July, 1981 be set aside and the respondents be directed to consider him for promotion to the rank of Sub-Inspector of Police with effect from the date he deserves with all back benefits. 3. Brief facts of the case are that the appellant was recruited on 1st May, 1947 in Punjab Police as Foot Constable.
