(a) Specific Relief Act (I of 1877)- S. 12 read with Companies Act (VII of 1913), Ss. 171, 178, 179, 227, 229, 230, 230 :A & 232 and Provincial Insolvency Act (V of 1920), S. 34-Specific performance of contract against Company under liquidation-Petitioner entering into different agreements to purchase immovable property belonging to Company and paying substantial amounts on signing of agreements - Official liquidator, however, appointed and winding up order passed before deeds could be completed-Petitioner praying that either sale deeds be executed by way of specific performance of agreements to sell or leave be granted to file suits for specific performance of such agreements-Held, such . agreements are onerous though Liquidator not disclaiming same and that allowing specific performance would amount to undue performance and affect other creditors adversely--Petitioners to rank as secured creditors for their deposits and costs-Application dismissed.
