(a) Industrial Relations Ordinance (XXIII of 19691-- -- S. 50 read with Employees' Cost of Living (Relief) Act, 1973 (I of 1974); S. 3 (4) and (5) [as amended vide Employees' Cost of Living (Relief) (Amendment) Ordinance (XXV of 1981)-Settle­ment-lnterpretation of--Claim for set off of allowance payable under Employees' Cost of Living (Relief) Act, 1973 against amounts payable under settlement-involves normally question whether requirements of set-off fulfilled depending upon provisions of settlement-Within abmit of S. 50 of. Industrial Relations Ordi­nance, 1969 and within jurisdiction of Labour Appellate Tribunal. (b) Industrial Relational Ordinance (XXIII of 1969)--- ----S. 50--Settlement-Locus standi-Employer when party to settlement-Entitled to make reference to Labour Appellate Tribunal. (c) Employees' Cost of living (Relief) Act, 1973 (I of 1974)- '' --S. 3(4) & (5) [as amended vide Employees' Cost of Living (Relief) (Amendment) Ordinance (XXV of 1981)-Set off against Allow­ances and amounts payable under settlement--Permissible only in respect of amounts payable' as a relief due to rise in cost of living ­Additional increment allowed under settlement to permanent workers not as a normal increment but on account of special circumstances as an effort to compensate workers against rise in cost of living--Subject to set off-Increased wages allowed under settle­ment attributable to rise in cost of living-Subject to set off-Heat allowance-Allowed under settlement to workers at different rates according to degree of heat or extent of exposure to heat-Not subject to so-off-Washing allowance increased under settlement due to increase in prices of soap, detergents etc.-Subject to set­off-House Rent allowance allowed as a compensation to workers ' g°., who tire not provided residential quarter--Not subject to set-off.
