Punjab Service Tribunals Act (IX of 1974)-- ----- S. 4-Promotion-Not within, jurisdiction of Tribunal-Police constable having passed prescribed test for promotion as Head Constable-Departmental authorities appreciating claim but failing to make promotion and directing that no representation should be made--Tribunal in circumstances, declining to pass effective order but observing that departmental authorities may examine deserving case sympathetically. JUDGMENT M. SALEEM CHAUDHRY (CHAIRMAN).-In this case the appellant, who joined the Police Department, as Constable in 1956, was brought on List `A' meant for promotion to the post of Head Constable of Police on 23rd June, 1959. But his name appears to have been removed from the same in 1960. He was again re-enlisted on 15th November, 1965 and, .was brought on List `A' maintained in the district of Dera Ismail Khan. Earlier he appeared in test in 1961 for promotion to 'List `B', but the result was withheld as he was under orders of transfer to Mianwali. However, according to the information received later, he was said to have passed the test. The appellant went on representing for his promotion.
