Punjab Civil Servants (Efficiency and Discipline) Rules, 1975-- Misconduct-Compulsory retirement on charges of corruption­ Charges not supported by facts on record-Adverse remarks for year 1960 relied upon while passing order in 1976-Remarks in reports pertaining to distant time, held, should not form sufficient basis to justify major penalty of compulsory retirement-Order of compulsory retirement, in circumstances, set aside. SALEEM CHAUDHRY (CHAIRMAN).-The appellant who was a Naib Tehsildar impugnes the order dated 16-3-1976 of the Commissioner, Multan Division Multan, retiring- him from service compulsorily and the order dated 10-9-1976 of the Member, Board of Revenue, rejecting his appeal. 2. The facts of the case, as stated before us, are that during 1975-76, the appellant was proceeded against under the Punjab Civil Servants (Efficiency and Discipline) Rules, 1975 in three separate cases. The first case relating to his tenure as A. C. O., Lodhran was based on allegations made by one Abdul Hameed Khan, Member of the Advisory Committee, M013 Sal Sadar, Tehsil Lodhran and briefly contained the following main charges (i) that he had prepared Wandajat and announced them in the ijlas-e-Aam but instead of securing the signatures of the interested on the specific Wandajats, their signatures were obtained in the blank columns of the Register of Consolidation Scheme and Wandajat and the proposals were filled in later on; (ii) that he made amendments in a number of Wandajat after announcing the proposals; and (iii) that he passed order in Column No. 10 of the Register without proposal by the Field Kanugo in Column No. 9 of the Register. In the second case he was confronted with adverse remarks relating to his A, C. Rs. for the year 1960, 1961, 1969 and Special Report for 1974 which showed that the reputation regarding his integrity was bad and he was considered to be corrupt. Ultimately, however, the Commissioner in his order only held the remarks relating to 1960 and 1974 to be standing against him. 3. In the third case it was alleged that while posted as A. C.
