Land Reforms Regulation, 1972 [M. L. R. 115]--------- -- Para. 25(3)(d) read with Constitution of Pakistan (1973), Art. 203-B-Mubammadan Law of Pre-emption--Right of pre-emp¬tion vests in co-sharers, participators in amenities and appendages, and contiguous owners-Right of ownership in property or right investing pre-emptor with preferential right of pre-emption, and not mere possession, give a right of pre-emption-Tenant in possession on behalf of landlord-Cannot be given right of pre-emption in pre¬ference to such three classes of right-holders--Clause (d) of sub-para. J.-Haji Niamatullah Khan and Zul Qadir have moved this petition under Article 203-B of the Constitution, so as to seek a declaration that: Clause (d) of sub-para. (3) of paragraph 25 of M. L. R. 115, granting a tenant first right of pre-emption, in respect of land, comprised in his tenancy, is against the Injunctions of Islam.
