Constitution of Pakistan, 1973-- ----Art. 199--LL.B Degree--Equivalence with Master’s Degree--Grant of additional marks--Recruitment (elementary school educators)--Policy interpretation--No prohibition in advertisement/rules--recognition by higher education commission--Vested rights-similarly placed candidates--At the very outset, Law Officer was asked to show from advertisement as well as policy that LL.B degree is not equal to Masters degree--However, he could not substantiate that respondents were not entitled for award of additional marks of LL.B degree--We had noted that there was no prohibition in advertisement as well as in policy to award additional marks to LL.B degree holders for appointment against post in question and admittedly Higher Education Commission had recognized it equal to Mastersdegree on basis of years of education--We also agree with findings given by Single Judge that decisive steps have already been taken on both sides whereby vested rights have been created in favour of respondents for post in question--Petition allowed.                                                                                        [Para 5] A Mr. Saif-ur-Rehman Jasra, Advocate for Petitioners.
