Criminal Procedure Code, 1898 (V of 1898)-- ----S. 497--Pakistan Penal Code, 1860 (XLV of 1860), Ss. 324/34--Bail dismissal of--Attempt to murder--Common intention ground--Involved in so many cases--Fire-arm injuries--Important aspect of present bail application is whether it falls within ambit of Section 324 or not--The applicant was accused of actively engaging in an incident that clearly falls under offence of mischief as defined in Section 324 of Pakistan Penal Code, 1860--This offence carries a punishment of imprisonment for up to ten years--The application of Section 497 of Code, which prohibits circumvention of bar on bail in cases where there are reasonable grounds to believe accused is guilty, is relevant in this case--In this context reliance can be placed--At bail stage, only a tentative assessment is to be made, and deeper appreciation is not permissible--There is sufficient material on record to connect applicant accused with commission of offence--Police file reflects that petitioner/accused is involved in four other criminal cases--The Hon’ble Supreme Court of Pakistan declined bail on ground that petitioner had been involved in more than seven cases--The offence falls within prohibitory clause of Section 497, Cr.P.C.--Court is not not inclined to grant post-arrest bail to applicant accused--Criminal bail application is dismissed.                                                                [Pp. 565, 566 & 567] A, B & C PLD 2021 SC 903.
