Constitution of Pakistan, 1973-- ----Arts. 199 & 212--Writ Petition--Civil Servant--Promotion--Seniority--Departmental Promotion Committee--Disputed Questions of Fact--Delay and Laches--Service Matter--Maintainability--Admittedly, petitioner is a civil servant and his colleagues were recommended for promotion through Departmental Promotion Committee; however, petitioner did not challenge said promotions before appropriate forum--Even otherwise, petitioner sought benefit of seniority, etc., which involves disputed questions of fact requiring evidence and could not be adjudicated under writ jurisdiction of this Court, matter being barred under Article 212 of Constitution of Islamic Republic of Pakistan, 1973--Besides, petitioner had challenged earlier notification after a lapse of more than three years; therefore, this petition is also hit by laches--Petition dismissed.                                             [P. 92] A Mr. Muhammad Nishat Warsi, Advocate for Petitioner.
