Case Summary
The petitioner sought pre-arrest bail under Section 498 Cr.P.C. in FIR No. 503/2026, registered at Police Station Kotwali, Bahawalpur, under Sections 341, 188 PPC and Section 16 of the Punjab Maintenance of Public Order Ordinance, 1960.
The prosecution alleged that the petitioner, acting as administrator, conducted a Noha Khawani and Matam Dari procession on 26.06.2026 at about 11:00 p.m., in violation of the approved route, causing obstruction and inconvenience to the public.
The Court found that although the petitioner was nominated in the FIR, a significant circumstance was that after the alleged occurrence, the District Police Officer, Bahawalpur issued him a Certificate of Appreciation dated 09.07.2026, praising his cooperation with police and his efforts in maintaining peace and law and order during Muharram, particularly regarding Majalis, Noha Khawani and Matam Dari. This circumstance did not prima facie fit with the prosecution's allegation that he had caused disturbance and public nuisance.
