Summary
The petitioner had filed a suit for possession of a property based on a registered Sale Deed of 1993. The Trial Court decreed the suit in his favour on 28.10.2022, and possession was delivered to him through execution proceedings on 22.11.2022.
During the pendency of the litigation, Respondent No.3 (Arabian Private Limited) claimed that it had purchased the same property through sale deeds dated 19.12.2020 and 04.08.2021. Since these purchases were made while the litigation was pending, they were pendente lite transactions.
Respondent No.3 applied under Order I Rule 10 CPC to become a party to the appeal. The Appellate Court allowed the application, but went further: it set aside the Trial Court's decree, remanded the case for fresh decision, and directed restoration of possession to Respondent No.3.
