Summary
This case is about territorial jurisdiction of a Family Court in a suit for Khula, maintenance, dowry articles and treatment expenses.
The petitioner filed her family suit before the Family Court, Jahanian. Khula was granted, and the Family Court awarded her Rs.15,000 as Iddat maintenance and Rs.150,000 as the alternate value of dowry articles, while her claims for past maintenance and treatment expenses were dismissed.
The Additional District Judge, Jahanian later set aside the Family Court's judgment on the ground that the Family Court allegedly did not have territorial jurisdiction, mainly because the petitioner had mentioned an address in Tehsil Mailsi during cross-examination.
