SHAIKH (CHAIRMAN).-The appellant bad filed this appeal on 10th December, 1973 in respect of his seniority as Senior Scale Stenographer via-a-via respondents Nos. 2 and 3. One Mr. Muhammad Abdullah was also joined as respondent No. 4 but he died during the pendency of this appeal. Consequently the appeal as against him stood abated. 2. The case of the appellant is that in May, 1970 when he was serving as a Stenographer with Deputy Commissioner, Loralai, a circular letter was issued by the Commissioner, Quetta Division saying that 40 stenographers would be required for Baluchistan Secretariat and that persons who are already serving as a Stenographers in the districts could apply for the post. This circular letter is dated 15th .May, 1970 and has been filed by the appellant as Annexure A with his appeal. 3. In pursuance of this circular the appellant made an application to the Commissioner. Quetta Division (Establishments Branch) on 22nd May, 1970 praying that he may be considered for appointment against one of the posts mentioned in the above circular. On 24th June, 1970. the Deputy Commissioner was informed that the appellant may be asked to take a teat for Senior Scale Stenographers to be held on 27th June, 19710 in the Baluchistan Secretariat. He was further informed that successful candidates will have to appear before the Selection Board for interview on 28th June 1970. 4. The Deputy Commissioner, Loralai sent a telegram to Commissioner. Quetta on 26th June, 1970 saying that the appellant cannot be spared for the test which was to be held on 27th June.…
