Summary In this judgment, the Supreme Court of Pakistan (Muhammad Hashim Khan Kakar, J.) granted post-arrest bail to a foreign national (a Pakistani woman's husband) who had been booked under section 14 of the Foreigners Act, 1946 for residing in Pakistan without a valid visa/residence permit. The Court held that the FIR contained no allegation of knowingly entering Pakistan illegally, so the accusation fell under section 14(1) (maximum 3 years), not section 14(2) (up to 10 years). Consequently, the bail embargo under section 14A — which applies only to section 14(2) offences — was not attracted, and the offence fell outside the prohibitory clause of section 497 Cr.P.C. where bail is the rule. It concluded that penalizing a foreign husband while his status determination remains pending before administrative bodies converts executive delays into punitive incarceration, and that the case fell within the ambit of "further inquiry" under section 497(2) Cr.P.P.C. The FIR did not allege that he knowingly entered Pakistan illegally — the case rested only on his continued presence after administrative changes regarding PoR cards and notifications. Since the accusation falls under section 14(1) (max 3 years) and not section 14(2) (up to 10 years), the bail embargo in section 14A is inapplicable, and the offence falls…
