(a) Criminal trial Witness-Evidence, appreciation of-Evidence of a witness cannot be rejected on mere ground of relationship.-[Witness-Evidence): (b) Penal Code (XLV of 1860) S.302-Murder-Evidence, appreciation of-Accused coming armed with a hatchet, launching attack on his victim and giving her 4 hatchet blows in region of head-Eye-witnesses of occurrence inmates of house closely related to accused and having no reason to falsely implicate him, on charge of murder -Testimony of such witnesses fully corroborated by circumstantial evidence as well as motive for crime-Accused, held, had no other intention, but to cause death of deceased--Conviction and sentence of death maintained in circum. stances. Dates of hearing : 19th and 20th May, 1980.                                                                                                                                   JUDGMENT MAIJAMMAD ZAHOORUL HAQ, J.--This is a case for confirmation of death sentence under section 302, P, P. C. awarded to Jaro by the II Additional Sessions Judge, Larkana on 30th May, 1979, Jaro was also convicted under section 326, P. P. C. and sentenced to suffer four years' R. I. and he was further sentenced to suffer one year R. I. under section 324, P. P. C. sentences of imprisonment were ordered to run concurrently in case the sentence of death was not confirmed. The appellant has also sent an appeal from Jail, which is being disposed of by the same judgment. The appellant was heard in person and he submitted that he was innocent and had been falsely involve.". Mr. Salman Ansari also appeared for him on State expense;.
