Summary The Supreme Court of Pakistan dismissed the department’s civil appeals, holding that the omission to levy Workers’ Welfare Fund (WWF) in a deemed assessment under section 120 of the Income Tax Ordinance, 2001 could not be treated as a “mistake apparent from the record” rectifiable under section 221. The Court emphasized that determining whether Sui Northern Gas Pipelines Ltd. qualified as an “industrial establishment” under the Workers’ Welfare Fund Ordinance, 1971 required detailed factual inquiry and legal interpretation—matters that are debatable and thus outside the narrow scope of rectification. Consequently, the department could not create a fresh WWF liability via section 221 rectification proceedings; any recovery of WWF must follow the distinct recovery mechanism under section 4 of the 1971 Ordinance. Core Points The taxpayer’s return was deemed assessed under section 120 of the Income Tax Ordinance, 2001; later, the department sought to impose WWF @ 2% via section 221 rectification. The key issue was whether non-charging of WWF constituted a “mistake apparent from the record” justifying rectification. The Court held that deciding WWF liability first requires establishing the taxpayer’s status as an “industrial establishment” under section 2(f) of the 1971 Ordinance—a debatable, fact-intensive inquiry. Rectification under section 221 is limited to obvious, patent errors (e.g., clerical or arithmetical mistakes) and cannot be used to re-open assessments, re-argue debatable points, or create new liabilities. The department’s attempt to conflate WWF recovery with income tax assessment/rectification under the 2001 Ordinance was impermissible; WWF is a separate levy with its own recovery provisions under section 4 of the 1971 Ordinance. The Supreme Court affirmed the concurrent findings of the Tribunal and Lahore High Court and dismissed the appeals, answering questions (ii) and (iii) against the department.
