 Case Summary

Judge: Inaam Ameen Minhas, J.
Decision: Writ petition dismissed.
Date: 16.04.2025
Subject: ADB debarment, cross-debarment, PPRA Rules and eligibility in public procurement.

1. Facts

The petitioner participated in a WAPDA tender for 500 KV SF6 Circuit Breakers for Tarbela Power Station and was declared the lowest bidder. During evaluation, it emerged that the petitioner had been debarred by the Asian Development Bank (ADB) from 22.12.2022 to 22.12.2026.

The petitioner argued that the ADB debarment was limited to ADB-funded projects and therefore did not prevent participation in the Pakistani tender. ADB had also clarified that the debarment was not a cross-debarment within ADB's system.
