Case Summary
Nature of case: Constitutional writ petition challenging dismissal of an application under Sections 22-A & 22-B, Cr.P.C. for registration of an FIR.
Core facts:
The petitioner claimed that he purchased his brother Ahmed Yar’s share in a shop at G-8 Markaz, Islamabad for Rs.6.5 million, supported by agreements dated 02.08.2022 and 29.09.2022. He later discovered that Ahmed Yar had allegedly sold the same share to another brother, Nigar Khan. Alleging fraud and criminal breach of trust, he sought registration of an FIR. The SHO declined, and the Ex-Officio Justice of Peace also dismissed his application under Sections 22-A & 22-B Cr.P.C. The petitioner then invoked constitutional jurisdiction.
