Case Summary
The dispute concerned Plot No. 386, Block-E, Government Employees Cooperative Housing Society, Bahawalpur, originally allotted to Muhammad Irshad Ali. After his death, his legal heirs sought transfer of the plot in their names. The petitioner claimed ownership on the basis of a General Power of Attorney (GPA), an agreement to sell, and nomination made by the deceased, and relied upon an order passed by the Deputy Registrar under Section 54 of the Co-operative Societies Act, 1925.
The Trial Court decreed the suit in favour of the legal heirs, and the Appellate Court upheld that decree. The petitioner filed the present civil revision.
The High Court held that nomination under Section 27 of the Co-operative Societies Act does not confer ownership but merely enables the cooperative society to make an administrative transfer. The nominee remains accountable to the legal heirs and cannot defeat their inheritance rights.
