A minor conviction based on a voluntary plea of guilt, resulting only in a nominal fine, should not permanently stigmatize an individual by being reflected as an adverse entry in a Police Clearance Certificate.
Summary
The petitioner sought a Police Clearance Certificate (PCC) without mention of his conviction in FIR No. 820/2024 under Sections 3/4 of the Emigration Ordinance/Act (EHO). He had voluntarily pleaded guilty before the Magistrate, was convicted, and sentenced only to a fine of Rs. 1,000, which he immediately paid. No appeal or revision was filed, and the conviction attained finality. However, when he later applied for a PCC, the conviction was reflected therein, adversely affecting his reputation and future prospects.
The High Court held that although the conviction was lawful and valid, the real issue was whether a minor conviction carrying only a nominal fine should permanently appear as an adverse character entry in a Police Clearance Certificate. The Court observed that modern criminal justice embraces reformative and restorative principles, and the purpose of accepting guilty pleas in petty offences is to ensure speedy and inexpensive justice. Treating every minor conviction as a lifelong stigma defeats this objective and violates the principle of proportionality.
