Law: Pakistan Penal Code (PPC),1860

Section: 406, 34

Summary The petitioner sought post-arrest bail in an FIR registered under Sections 302, 324, and 34 PPC for the alleged murder of his own son. Initially, the petitioner himself had lodged the FIR accusing his ex-wife and others. However, during investigation, the police concluded that the petitioner had fabricated the story to falsely implicate his ex-wife and that he himself committed the murder. The investigation resulted in the recovery of the alleged weapon on the petitioner's disclosure, his confession during investigation, and forensic evidence linking the weapon with human blood. The Islamabad High Court held that, at the bail stage, only a tentative assessment of the evidence is required. The Court found sufficient tangible incriminating material, including the petitioner's disclosure, recovery of the blood-stained knife, PFSA report, and medical evidence, which prima facie connected him with the offence. Since the alleged offence falls within the prohibitory clause of Section 497 Cr.P.C. and carries capital punishment, the petitioner failed to establish grounds for bail. Consequently, the post-arrest bail petition was dismissed, with observations being purely tentative and not affecting the trial. Legal Core Points Post-arrest bail under Sections 302/324/34 PPC was refused. Court applied the principle of tentative assessment of evidence at the bail stage. Tangible incriminating evidence existed: Petitioner's alleged confession during investigation. Recovery of the blood-stained weapon on his disclosure. PFSA report confirming human blood. Medical and post-mortem evidence supporting the prosecution case. Offence falls within the prohibitory clause of Section 497 Cr.P.C., making bail an exception. Relied on: PLD 2021 SC 738 (Muhammad Sarfraz Ansari) – requirement of tangible material at the bail stage. 2021 SCMR 518 (Abid Hussain v. Tassawar Hussain) – bail is governed by the statutory framework once an accused is in custody. Held: Petition dismissed; observations are tentative and will not prejudice the trial.
