Facts

The petitioner challenged the order of the Judge Family Court dated 10.06.2026, whereby his right to produce evidence was closed and his affidavit of evidence was discarded. He argued that he had not been given sufficient opportunity to lead evidence and that his counsel was unable to appear due to illness, supported by a medical certificate.

The underlying family suit, filed in 2019, involved dissolution of marriage (Khula), recovery of dowry articles, and maintenance. Despite the statutory requirement of speedy disposal, the case remained pending for nearly seven years.
