Summary of the Federal Constitutional Court of Pakistan Order (13 July 2026)

Background

The case concerns the Monal Restaurant located in the Margalla Hills National Park (MHNP), Islamabad. The dispute arose over which government authority had the legal power to lease the restaurant site:

  • Capital Development Authority (CDA) leased the site to Monal in 2006 for 15 years.
  • In 2019, the Remount, Veterinary and Farms Directorate (RV&FD) claimed ownership of the land and signed a new lease with Monal.
  • Monal filed a civil suit seeking a declaration that its lease with RV&FD was valid and that CDA could not claim rent.
  • At the same time, the Metropolitan Corporation sought Monal's eviction.

While these civil suits were still pending, the Islamabad High Court decided several environmental cases relating to MHNP together with Monal's interim appeals and declared the 2019 lease void. The Supreme Court later upheld that judgment in August 2024 and further ruled that all restaurant leases in MHNP were illegal.

The Metropolitan Corporation and CDA then filed these review petitions.
