Law: Constitution of Pakistan, 1973

Section: 199

Summary The petitioner challenged the office order dated 13.04.2022 and sought extension of his contract as National Project Coordinator under the National Program for Improvement of Water Courses in Pakistan, Phase-II. He argued that his performance was satisfactory, the evaluation process for extension was deliberately delayed, and a fresh recruitment process was initiated with mala fide intentions. The Court held that the petitioner was a contract employee, and his contract had expired on 15.01.2022. A contract employee has no vested right to extension or continuation in service, and constitutional jurisdiction under Article 199 of the Constitution cannot be used to enforce a contractual employment. The Court further observed that allegations of mala fide require evidence and cannot be decided in writ proceedings. Since no violation of law or rules was established, and recruitment policy falls within the authority of the competent government department, there was no basis for judicial interference. Final Decision The writ petition was dismissed in limine, and the Court upheld the government's decision to proceed with fresh recruitment.
