Law:

Section: 4C, 9, 92

Brief Facts,; This income tax appeal was filed by the taxpayer, Muhammad Fazal ur Rehman, against the order of the CIR (Appeals-VI), Karachi. The case relates to the levy of Super Tax under Section 4C of the Income Tax Ordinance, 2001, for the Tax Year 2022 on the taxpayer's share of income from an Association of Persons (AOP). Taxpayer's Grounds for Appeal: The taxpayer challenged the assessment on several legal and factual grounds: Exempt Income: The taxpayer argued that his only source of income was a share from an AOP (M/s Jamaluddin & Co.), which is exempt from tax under Section 92(1) of the Ordinance. Double Taxation: It was contended that since the AOP (the firm) had already been taxed under Section 4C, taxing the individual partner’s share again would amount to double taxation. Misinterpretation of "Taxable Income": The taxpayer argued that Section 4C applies to "taxable income" as defined in Section 9, which specifically excludes exempt income. Judicial Precedent: The taxpayer relied on a Sindh High Court ruling (CP No. 5842 of 2022) which stated that Section 4C should be applicable from the Tax Year 2023, not 2022. Department's Position: Inclusion in Total Income: The Departmental Representative (DR) argued that because exempt income is included in the definition of "total income" under Section 10, it should be subject to Super Tax if declared in the return. Support of Lower Orders: The DR maintained that the original assessment and the appellate order were well-reasoned and should be upheld. Tribunal's Final Decision: Clarification on "Taxable Income": The Tribunal clarified that while "total income" (Section 10) includes exempt amounts, the levy of Section 4C is strictly based on "taxable income" as defined under Section 9. Statutory Character: The Tribunal ruled that simply disclosing AOP share in a tax return does not change its statutory character as exempt income. AOP Share and Super Tax: It was held that a share from an AOP is not part of the income…
