VERSUS

Additional District Judge, Islamabad (West), etc.

Law: Constitution of Pakistan 1973

Section: 10-A, 199

Law: Islamabad Rent Restriction Ordinance, 2001

Section: 19

Tagline

A tenant who undertakes before the High Court to vacate the premises is estopped from resiling from that undertaking; transfer of ownership does not extinguish tenancy, and filing of an eviction petition constitutes sufficient notice under rent law.

 Summary

The petitioner challenged the eviction order dated 14.09.2024 passed by the Rent Controller, Islamabad, and the appellate order dated 12.10.2024 passed by the Additional District Judge, Islamabad, whereby his eviction from the rented premises (Plot No. 34, I&T Center, Sector G-9/4, Islamabad) was maintained.

The petitioner argued that there was no landlord-tenant relationship with the new owners, that mandatory notice under Section 19 of the Islamabad Rent Restriction Ordinance, 2001 had not been served, and that the Rent Controller had passed the eviction order without recording evidence, thereby violating Article 10-A of the Constitution.
